while it may be a scam its a far cry from an injustice. The propper actions should have been taken prior to this happening and i am not handicapped or even know someone handi capped. Just my 2 cents

How horrible to do this to small struggling businesses. Instead of suing small businesses, why don't the Fabians and Zuckermans join the fight to make public schools ADA compliant? I hope all businesses after being sued make sure Fabian regularly patronizes their establishments. Fabian must make good money to frequent such a high number of businesses year round.

It's a scam obviously and will end up hurting businesses, customers AND persons with disabilities - because it will come to a head and things will change in a way that handicapped people won't like. It's like crying racism - people who do that for personal gain end up making real complaints seem like a joke. Stupid and evil people mess up things for everyone.

this issue has cramped the USA law system for a while. In NYC, they were going to put public restrooms on the street corners like the ones in Paris- very clean etc.) , but because they were not handicapped friendly, the handicapped gang sued and they were not put in. ... so for a small minority, a large majority suffers. (one knows how scant bathrooms are in NYC- except for going in a restaurant, probably buying something you dont want. just for the restroom use-)
you know, everyone probably feels bad for the handicapped people, but you know what.. sorry. sorry that you have to live life like that and this unfortunate situtation happenned to you...but its your reality. Are you going to sue automobile manufacturers next for lack of handicapped acessible features? or the film industry if you are blind, since you cant see ?

Wow, this is really discouraging. Another example of the system gone haywire. One person making money at the expense of others. And disabled people aren't the one making the money......the business community suffers.....what a shame. Thank you BizSense for bringing this to our attention.

With so many of these letters going out (there have many more recipients than were listed in this article-myself included), I have a hard time believing there is nothing for the complainants besides satisfaction while Mr. Zuckerman makes all of the money in these scenarios.

After obtaining all of the necessary inspections and estimates, I can say from my own experience that PoeKnows is incorrect in his assertion that my "complaints about the expense of compliance" are monetarily driven. (My establishment is quite young so I personally take a liberal pay policy. read: I rarely pay myself so I can pay my staff.) We are not being greedy, we're trying to remain viable. Add to the cost of the improvements Mr. Zuckerman's fees and the cost could become insurmountable. When the economic climate changes, if owners balk, then yes, their motivations might be monetarily driven but certainly not now.

Good article Mr. Harris. Thanks for the warning.

Welcome to the 21st century folks. As much as Zuckerman looks the opportunist, this is a civil rights issue, and there is no case against it. Complaints about the expense of compliance are not only futile, but cast the business owner as a selfish, greedy villain who puts monetary gain over the rights of disabled individuals.

as a shopping center owner Mr. Zuckerman made it clear he wanted money and could care less about the conditions.. it cost us about 15,000.00 . The Bar should do something about this guy.
