Samuel L. Nussman v. Giant Food Stores, LLC d/b/a Martin’s Food Markets and Jeffrey Scott Whisnant
Plaintiff, a police officer, says he was in Martin’s at 6401 Centralia Road with fellow officer Mark D. Bowen to eat dinner, and both were off-duty, dressed in civilian clothes, without guns or handcuffs. Plaintiff says Whisnant, who was unknown to them, approached their table and asked if they knew an officer named “ski.” Plaintiff says when both responded no, defendant punched Bowen in the face. Plaintiff says he rose from his chair as defendant unleashed a torrent of blows to his head, and began pulling his shirt over his head so he couldn’t defend himself. Defendant pulled both to the floor – he was physically imposing and under the influence of alcohol and drugs plaintiff alleges, and is now incarcerated. Plaintiff says he was repeatedly struck and kicked by defendant, and despite pleas to employees to call 911, no Martin’s agents came to their aid or called. Six minutes after the attack began, plaintiff says, another off-duty officer entered the store and called 911. Plaintiff alleges assault and battery against Whisnant and negligence against Giant, and says he has been forced to incur substantial medical bills. Plaintiff seeks judgment in principal sum of $2 million.
